The Environmental Practice group’s involvement in environmental matters dates back to the 1980’s when Harrison & Moberly represented battery recycling entities in both state and federal litigation with the U.S. EPA. This history evolved into representation of various types of entities in environmental matters including actions before administrative agencies such as the Indiana Department of Environmental Management (IDEM) and in Federal Superfund Litigation in Indiana as well as in the States of New Jersey and Tennessee.
Harrison & Moberly represents manufacturing entities as well as gas station and dry cleaner owners who have operated or acquired property contaminated by petroleum products, volatile organic compounds or other potentially hazardous substances. The attorneys at Harrison & Moberly are dedicated to working with the client and their environmental contractors to arrive at innovative and cost-effective means for cleanup. These methods frequently involve working with administrative agencies such as city and state Brownfield departments and IDEM to craft a cleanup plan using applicable IDEM guidance and the appropriate IDEM program. The attorneys at Harrison & Moberly have extensive experience with IDEM’s Brownfields Program, the Voluntary Remediation Program (VRP), the State Cleanup Program, the Leaking Underground Storage Tank (LUST) Program, the Excess Liability Trust Fund (ELTF), and RCRA Corrective Action, and the Superfund and Defense Environmental Restoration Program.
In addition to representing individuals and manufacturers with their environmental issues, Harrison & Moberly also has represented farmers and has addressed the unique environmental issues posed by confined feeding operations (CAFO’s).
Harrison & Moberly will also assist the client in identifying other sources of funding for cleanup such as through historical insurance policy coverage and/or other potentially responsible parties. Our goal is to achieve a winning and cost-effective solution for the client.
